Summer Camp Waiver

Please note that Janet Lange Art & Design and staff, Knox’s Pumpkin Farm and staff and 1840 Farmhouse and Vineyard and staff are not responsible for you or your child(ren) if any injury, illness, accident or death occurs on any Janet Lange Art & Design camp premises, including (but not limited to): Knox’s Pumpkin Farm located at 6325 Enfield Rd, Hampton, ON L0B 1J0 and/or 1840 Farmhouse and Vineyard, located at 3775 Ganaraska Road, Orono, Ontario.

Please be advised that all Janet Lange, Art & Design Senior Camp Counsellors have up-to-date C.P.R. and First Aid training certificates. Please be advised that all Janet Lange, Art & Design Junior Camp Counsellors have C.P.R. training only.

If a situation arises with you or your child(ren) that results in you or your child(ren) needing professional medical help and you or your emergency contact are unavailable to attend, please sign below to allow Janet Lange and/or her staff to arrange for you or your child’s emergency medical treatment, including, if necessary arranging transportation via ambulance. By signing below you explicitly agree to assume all costs associated with you or your child(ren)’s medical treatment, including but not limited to: ambulance transportation, epinephrine injection, attendance of paramedics on site, etc.

I understand Janet Lange, Art & Design and/or its servants, agents or officers and Knox’s Pumpkin Farm, and/or its servants, agents or officers, and 1840 Farmhouse and Vineyard, and its servants, agents or officers shall not be held responsible if I, or my child(ren) experience any accident, illness, injury or death while attending a Janet Lange Art & Design camp at Knox’s Pumpkin Farm located at: 6325 Enfield Rd, Hampton, ON L0B 1J0 and/or at 1840 Farmhouse and Vineyard, located at 3775 Ganaraska Road, Orono, Ontario.

I, the undersigned, hereby expressly acknowledge:

• I am actively aware of the risk(s) to me and my child(ren) of participating in classes and activities run by Janet Lange Art & Design, including but not limited to: art materials and supplies, tractor rides, trail walks, farm animals, and exposure to wildlife, flowers, and plants and allergens.
• I acknowledge that Janet Lange Art & Design camps operate on farms. Farms have many hazards, such as our animals, insects & birds including, but not limited to: Cows, goats, horses, chickens, donkeys, rabbits, ducks, turkeys and any other animal on the camp property. As on any farm there is uneven ground, fencing, gates, farm equipment and other hazardous items
• Janet Lange Art & Design and its hosts, Knox’s Pumpkin Farm and 1840 Farmhouse and Vineyard will not accept any liability for loss or injury that occurs on their premises to me, or my child(ren).
• I understand there is absolutely no smoking permitted on the farm grounds during any classes/activities offered by Janet Lange Art & Design.
• I agree to abide by Janet Lange Art & Design’s rules and regulations

For greater clarity, I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Janet Lange Art & Design and all servants, agents or officers of Janet Lange Art & Design, Knox’s Pumpkin Farm and all servants, agents or officers of Knox’s Pumpkin Farm, and 1840 Farmhouse & Vineyard and all servants, agents or officers of 1840 Farmhouse & Vineyard and to waive any and all claims, demands, or causes of action that I have or may have now or in future against Janet Lange Art & Design and all servants, agents or officers of Janet Lange Art & Design, Knox’s Pumpkin Farm and all servants, agents or officers of Knox’s Pumpkin Farm and 1840 Farmhouse & Vineyard and all servants, agents or officers of 1840 Farmhouse & Vineyard and I voluntarily release Janet Lange Art & Design and all servants, agents or officers of Janet Lange Art & Design, Knox’s Pumpkin Farm and all servants, agents or officers of Knox’s Pumpkin Farm and 1840 Farmhouse & Vineyard and all servants, agents or officers of 1840 Farmhouse & Vineyard from any and all liability for any loss, damage, expense or injury including drowning and/or death that me or my child(ren) may suffer or that my family, heirs, assigns, personal representatives and estate may suffer as a result of me or my child’s/children’s participation in or attendance at Janet Lange Art & Design summer camp or activities at any of the Janet Lange Art & Design Summer Camp locations DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDNG ANY DUTY OF CARE OWED UNDER THE OCCUPIER’S LIABILITY ACT, R.S.O. 1990, C.O. 2 ON THE PART OF JANET LANGE ART & DESIGN AND ALL SERVANTS, AGENTS OR OFFICERS OF JANET LANGE, ART & DESIGN, AND KNOX’S PUMPKIN FARM AND SERVANTS, AGENTS OR OFFICERS OF KNOX’S PUMPKIN FARM AND 1840 FARMHOUSE AND VINEYARD AND ALL SERVANTS, AGENTS OR OFFICERS OF 1840 FARMHOUSE AND VINEYARD FURTHER INCLUDING THE FAILURE ON THE PART OF JANET LANGE ART & DESIGN AND ALL SERVANTS, AGENTS OR OFFICERS OF JANET LANGE, ART & DESIGN, AND KNOX’S PUMPKIN FARM AND ALL SERVANTS, AGENTS OR OFFICERS OF KNOX’S PUMPKIN FARM AND 1840 FARMHOUSE AND VINEYARD AND ALL SERVANTS, AGENTS OR OFFICERS OF 1840 FARMHOUSE AND VINEYARD TO SAFEGUARD OR PROTECT ME AND/OR MY CHILD(REN) FROM THE RISKS, DANGERS AND HAZARDS OF JANET LANGE ART & DESIGN AND/OR KNOX’S PUMPKIN FARM AND/OR 1840 FARMHOUSE AND VINEYARD GAMES OR ACTIVITIES.

I acknowledge that the terms of this waiver have been explicitly brought to my attention, pursuant to the holding in Zaky v. 2285771 Ontario Inc., 2020 ONSC 4380 and that should any incident occur involving my child, that this waiver will operate as a complete defence to any claim.

Three Strike Policy

Janet Lange Art & Design Camp abides by a ‘Three Strike Policy’: there is absolutely no bullying, or physical violence at our camps. Three chances are given to each child. We strive for equality, respect for each other and personal possession and are committed to maintaining a safe environment to nurture friendships and lots of fun every day. If a child disobeys any of our rules, a warning (“Strike 1”) is given. “Strike 2” is a call home, and “Strike 3” is dismissal from our camp immediately, with no refund (even if all three strikes are administered on the first day) . Your signature below is attestation that you agree to abide by Janet Lange, Art & Design’s Three Strike Policy.

Any personal items left behind by your child(ren) at the end of the week will be donated to charity if not picked up within one (1) week.

Promotional Waiver

I consent to Janet Lange Art & Design taking photographs, videotape or digital recordings of me/my child and to use these in promotional materials, including but not limited to the website, newsletters, brochures, social media and additional marketing tools. I understand I may withdraw my consent at any time by contacting Janet Lange. We do not sell or distribute your personal information to any third party.

COVID-19 Acknowledgement

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization and COVID-19 is contagious. Janet Lange Art & Design has put in place preventative measures to reduce the spread of COVID-19; however, Janet Lange Art & Design cannot guarantee that a participant or parent will not become infected with COVID-19. Further, participating in the Summer Camp could increase the participant’s risk of contracting COVID19.
